NEW MANDATORY REPORTING GUIDELINES FOR COVID-19 CLAIMS

On September 17, 2020, California enacted SB-1159 which requires certain reporting requirements regarding COVID-19 cases being reported in the workplace. Effective immediately, all employers are required to report any positive COVID-19 cases to their workers’ compensation claim administrator, regardless if the employee contracted it within the workplace or not.

It is also important to note the new reporting guidelines also defines to separate periods in the requirements for COVID-19 claims. The first period is from the Governor’s Executive Order which captures claims from March 19, 2020 through July 5, 2020. The second period applies to claims with positive COVID-19 cases from July 6, 2020 through December 31, 2022.
